Haus Store Terms and Conditions of Sale

1. Definitions

1.1. In these conditions:
‘Condition’ means the standard terms and conditions of sale set out below, including any special terms and conditions agreed in writing by us; ‘Contract’ means any contract for Goods made between you and the Company; ‘Goods’ means the packaged products or services which we shall supply in accordance with these Conditions; ‘We’ means haus store which is part of the bathstore.com group registered in England No. 02240475 at Home House, 3 Albany Place, Hydeway, Welwyn Garden City, Hertfordshire, AL7 3UQ. Vat no.125517037.

2. Price

The price of the Goods shall be the price given on the date you place your order and will be confirmed on your invoice. The price of the Goods will include VAT at the prevailing rate.

3. Date for Payment

The customer shall pay for the Goods in full either at the time you place the order or, if a deposit has been paid, at least 28 days prior to delivery being made, with cleared funds, otherwise the delivery date will be cancelled and re-scheduled. For the avoidance of doubt payment is on an ‘upfront’ basis because the goods are specially made to order by the company’s German supplier and the company would find it difficult if not impossible to sell the goods to a third party.

4. Order Changes

No modifications, amendments or variations of the contract can be made once the order is ‘locked’. The term ‘locked’ means post customer sign off meeting and confirmation to produce goods in Germany.

5. Delivery

5.1 Our home delivery service will be explained at the point of order.

5.2 Home deliveries are generally made between 7.30am and 8pm. A convenient delivery date will be agreed with you within 28 days of placing your order. Goods are normally supplied within 10 weeks of an order being confirmed.

5.3 You shall be responsible for making all necessary arrangements to take delivery of the Goods.

5.4 A delivery supplement may apply for orders outside mainland Britain or in the Highlands of Scotland.

5.5 If You fail to take delivery of the Goods or fail to give us adequate delivery instructions on the date agreed for delivery, then We will charge You the subsequent delivery charge and admin fee.

5.6 If haus store are not installing your product we recommend that you take delivery at least 7 days prior to your installation start date.

5.7 If You do not check Your delivery is correct before installation commences haus store will not accept liability for any additional costs that You incur while any product issues are resolved.

5.8 You agree to accept delivery within 7 days of the initial date offered. We reserve the right to charge storage charges at the rate of 5% of your total order per calendar month.

5.9 Risk of damage to, or loss of the Goods shall pass to You at the time we deliver to your agreed delivery address.

6. Loss or Damage to Goods on Delivery

6.1 We recommend You examine the Goods to check that they are as ordered and undamaged within 7 days from the day after delivery. Please open each box and check that everything is as ordered and appears in good condition. haus store will replace Goods free of charge that have been incorrectly supplied or damaged in transit during their delivery. Please notify haus store within 7 days from the day after the day on which the Goods were received and We will arrange for a replacement item to be delivered and the damaged item to be collected.

7. Cancellation Rights

7.1 Due to the nature of the goods as specified in point 3 once confirmed the contract is non-cancellable, the only exception is where Goods supplied are faulty or not in accordance with the specifications of Your order then cancellation will be allowed on those items.

7.2 A refund will be reimbursed to You within 14 days from the day haus store receive the returned goods. We cannot accept the return of unwanted goods.

7.3 We cannot refund Goods that have been damaged or used while in Your possession.

8. Warranty and Liability

8.1 Proof of purchase is required before any warranty claim can be assessed. Guarantees are non- transferable with a change of ownership.

8.2 We shall make good by reimbursement of the whole or part of the price or, at our option, by repair or by replacement any defect developing under normal domestic use of the Goods within the stated guarantee period for the product affected.

8.3 Save as provided elsewhere, our liability for death or personal injury caused by our negligence shall be unlimited and for all other loss or damage which you may suffer or incur in connection with the supply of Goods, our liability shall be limited to that caused by a natural and reasonably foreseeable consequence for which we are at fault or negligent.

9. General

9.1 We shall have no liability whatsoever for any failure to perform, or for a delay in the performance of any of our obligations under the Contract arising wholly or in part by reason for any factor beyond our direct control.

9.2 In placing an order with us, You warrant that You are a resident of the United Kingdom and that you have the necessary permission and authority to enter this Contract.

9.3 Where any competent authority deems any Condition to be invalid or unenforceable in whole or in part, then the offending part shall be removed and the validity of the remainder of the Condition shall not be affected.

9.4 These Conditions do not purport to confer a benefit on any third party by the Contracts (Rights of Third Parties) Act 1999 by any person that is not a party to it.

9.5 The Contract and these Conditions shall be governed by the laws of England, and you agree to submit to the non-exclusive jurisdiction of the English courts.

9.6 Any notice required or permitted to be given by either party to the other under these Conditions shall be in writing addressed to the other party and delivered to the address provided at the time the order is confirmed or any subsequent or alternative address which one party may notify to the other from time to time.

9.7 The terms and conditions do not affect Your statutory rights.

10. Correspondence sent to Haus Store

By submitting a review, correspondence or feedback, you grant haus store and its group companies and partner companies, a non-exclusive, royalty free, sub-licensable, perpetual, world-wide license to use, modify, publish and distribute such content in any form or medium. You continue to own the content after it is published.

11. Imagery, Materials, Colours and Specifications

11.1 Any images act as a guide only, one of our colleagues will help you choose the appropriate items. When Your quote is produced, it’s Your responsibility to ensure the information and specifications are all correct.

11.2 Although we’ve made every effort to ensure the images are as accurate as possible, occasionally colours may not be a true representation of the product.
